Welcome to Weight Wise. By using our website and services, you agree to comply with and be bound by the following terms and conditions. Please review the following terms carefully. If you do not agree to these terms, you should not use this site or our services.

2. Consultations

All consultations provided by Weight Wise are non-refundable. Refunds may be granted solely at the discretion of the management team. Each case will be considered on its individual merits, and the decision of the management will be final.

3. Services

The services provided by Weight Wise are exclusively for medical consultations and the organization and procurement of supplies in accordance with Section 25 of the Medicines Act 1981. Weight Wise does not engage in the direct selling, resale, or wholesale of any medications. We are not a registered pharmacy nor a registered wholesaler.

Weight Wise acts on behalf of its client to utilize the "reasonable excuse" provision for the procurement of approved medications under Section 25 of the Medicines Act. The medications procured are listed on the New Zealand Universal Medicine List (NZULM). Clients acknowledge that we are not required to provide any information to Medsafe or the Ministry of Health under this exemption. Furthermore, clients agree that Medsafe may retain or confiscate our consignments without prior notice for any reason. Please refer to our cancellation and refund policy.

Weight Wise may not have direct contact with medicine suppliers and may use secondary or third parties to procure medicines for each client. Each batch of medicine is sent for independent laboratory analysis to test for specification and quality.

4. Shipping and Delivery

Shipping dates provided by Weight Wise are estimations only and are subject to change without notice. We cannot guarantee any specific delivery date until we receive confirmation updates from our logistical services and/or local couriers.

Clients should anticipate delays of up to and exceeding four weeks for the initial importation of medications. We will endeavor to keep clients informed of any significant changes to the estimated delivery times.

Weight Wise does not guarantee the fulfillment or complete delivery of goods during handling and transportation due to risks and circumstances beyond our control. Final fulfillment of orders may not occur. Please refer to the cancellation and refund policy.

Extra courier services are charged at our discretion and utilize local courier services, with prices subject to change depending on these services.

At a smaller scale, it is not economically feasible to ship with a complete cold chain. The client accepts by using our service that the cold chain logistics cannot be guaranteed. Weight Wise cannot ensure the medicines will function if it is caused by issues during its transport. Please refer to the Weight Wise Patient Information Sheet and FAQ.

Weight Wise does not offer, nor engage third-party services to offer, insurance for the shipping and delivery services provided.

5. Medical Disclaimer

The information provided by Weight Wise on the website nor any direct contact with clients is not intended as individualized medical advice, except in a formal telehealth video consultation or a face-to-face consultation. Our services should NOT be used as a substitute for your own registered General Practitioner. Always seek the advice of your attending physician/specialist(s) or other qualified health provider(s),such as your registered General Practitioner, with any questions you may have regarding a specific medical condition in the context of using our service(s).

6. Changes to Terms

Weight Wise reserves the right to change these terms at any time without prior notice. Your continued use of the website and services following any changes indicates your acceptance of the new terms.

7. Limitation of Liability

Weight Wise will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, our website or services. This includes but is not limited to reliance by you on any information obtained from the website that results in mistakes, omissions, interruptions, deletion of files or email, defects, viruses, delays in operation or transmission, or any failure of performance.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of New Zealand.
